• Company means Buzz A Driver Limited
  • Customer means the person, or company engaging in the series provided b the company.
  • Passenger means any person who enters any Buzz A Driver vehicle (other than employees/contractors of the Company) at the time the Customer is engaged in the services provided by the company.
  • Services mean the transportation needs being purchased by the Customer from the Company.
  • Contract means services agreed to by the Company and Customer.
  • Date of the contract means where the contract arises from a quotation given by the Company, 1) the date of acceptance of the order by the company. 2) Where the contract arises from a quotation given by the Company, the date upon written notification of acceptance of the quotation is received by the Company, or 3) the date when the service was provided.
  • Contract price means the price of the service as agreed between the Customer and the Company.
  • Person includes a corporation, association, firm, company, partnership or individual. Quotation shall mean price on offer for a fixed term. Manager is the companies appointed decision maker.
  • Buzz A Driver Vehicle means any vehicle owned, operated, leased or hired by the Company.

2. QUOTATION

2.1 The Customer may request a quotation from the Company setting out the price of the service to be provided. If the quotation is acceptable to the Customer, the Customer will need to pay 2 weeks prior to the trip being undertaken, with a non refundable bond of $500 being made to the company to lock in any booking at the time it is made.

3.1 These terms and conditions and any subsequent terms and conditions issued by the Company shall apply to any and all services provided to the Customer and any Passenger for the entire duration of the service provided. The Customer is responsible to ensure all Passengers abide by these terms and conditions and accepts full liability for any breach made.

 3.2 The Company may amend these terms and conditions (in whole or partly) at any time. The terms of trade (and any subsequent amendments will be effective once uploaded to the Company’s website (www.buzzadriver.co.nz). The Customer is responsible for ensuring they and all Passengers are familiar with the latest terms and conditions. The Customers engagement of services with the Company is a representation of the Customers acceptance to be bound by these terms and conditions.

4.1 Any damage caused by the Customer or any Passenger will be the full liability of the Customer.

4.2 If the damage was caused by any Passenger(s), it is the Customer’s responsibility to arrange to be compensated by those Passenger(s).

4.3 Failure to be compensated by any Passenger(s) does not relieve the Customer of their liability to repair the damage caused by any Passenger(s).

4.4 The Company, may, at its sole discretion, organise for the immediate repairs to be made by any third party of their choice. Full payment of the third party’s cost for repairs will be the sole liability of the Customer and must be paid on demand.

4.5 In the event of non-payment under clause 4 of this agreement, the Company reserves the right to initiate a claim against the Customer and or any Passenger responsible in the appropriate Court of Tribunal. The Customer shall be liable for all legal costs incurred on a solicitor/client basis.

5.1 All Customers and Passengers must act and behave in an appropriate manner at all times.

5.2 All passengers must listen to the driver, and follow all reasonable instructions given, any abusive, threatening or violent behaviour may result in person/s being removed from the bus, and any further costs incurred in getting home will be at their own expense.

6.1 The Price shall be as indicated on invoices provided by the Company to the Customer in respect of services provided.

6.2 Time for payment for the products and/or services shall be of the essence and will be stated on the invoice, quotation, or any other work commencement forms.

7.1 The method of payment will be made by cash, or by cheque or bank cheque or by direct credit or by any other method as agreed to between the Customer and the Company.

7.3 Late payment shall incur interest at the rate of 15%, per annum calculated on a daily basis. This shall be payable on any monies outstanding under the Contract from the date payment was due until the date payment is received by the Company, but without prejudice to the Company’s other rights or remedies in respect of the Customer’s default in failing to make payment on the due date.

7.4 Without prejudice to any other remedies the Company may have, if at any time the Customer is in breach of any obligation (including those relating to payment), the Company may suspend or terminate the service. The Company will not be liable to the Customer for any loss or damage the Customer suffers because the Company exercised its rights under the clause.

8.1 These Terms of Trade will be interpreted in accordance with the law of New Zealand and the parties submit to the jurisdiction of the New Zealand justice system.

9.1 Liability for payment of any legal costs incurred by the Company as a result of any breach of these terms and conditions rests with the Customer on a solicitor/client basis.

10.1 The Company shall not be liable for any loss of any kind whatsoever suffered by the Customers as a result of any breach of any of the Company’s obligations under the contract, including any cancellation of the contract or any negligence on the part of the Company, it’s employees, agents or contractors, nor shall the Company be liable for any loss, damage or injury caused to the Customer(s) or Passenger(s). The Customer shall indemnify the Company against any claim by such persons.

11.1 Should any clause in this Agreement be held invalid for any reason, the remainder of the Agreement shall continue in force and effect as if the invalid provision(s) had been deleted, provided however that the parties to this agreement may negotiate a valid and enforceable provision in replacement of the invalid provision(s).
